Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the Sub-Divisional Magistrate Nichlaul, District Maharajganj to protect the mismanagement and misappropriation of the property in dispute in compliance of the order dated 16.04.2018.
Learned counsel for the applicant submits that despite the order dated 16.04.2018 having been passed by the Sub-Divisional Magistrate, Nichlaul, Maharajganj, the same has not been given effect.
Without expressing any opinion on the merits of the case, this application is finally disposed of with an observation that the applicant shall at liberty to file an application alongwith a certified copy of this order before the Sub-Divisional Magistrate, Nichlaul within one week from today. Upon such application being filed the Sub-Divisional Magistrate, Nichlaul, Maharajganj shall pass a consequential order in furtherance of his order dated 16.04.2018 and give full effect to the same, if there is no other legal impediment.
