Heard Sri Rajesh Yadav, learned counsel for the petitioners and learned Standing Counsel for the State respondents.
The petitioners have filed the present petition seeking a direction upon the respondents to release the payment of the work done by them during the flood years of 2014-2015, 2015- 2016 and 2016-2017 within stipulated period.
Learned Standing Counsel was given time on 21.11.2019 to seek instructions in the matter if the amount as claimed by the petitioners is an admitted amount. He informs that though the petitioners have done some work but they have not submitted any completion certificate and as such the bills could not be processed and verified.
In view of the aforesaid facts and circumstances it is amply clear that the amount as demanded by the petitioners is not an admitted amount. In our opinion the petitioners are not entitled to any relief in exercise of writ jurisdiction. The petitioners may take recourse to civil proceedings or to arbitration, if there is a clause to the effect in the contract.
The writ petition is dismissed.
