Heard learned counsel for the applicant.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for wilful disobedience of the order dated 15.11.2019 passed in Writ C No.36964 of 2019 (Raj Kumari Vs. State Of U.P. And Others). The aforesaid order is quoted below:-
"1. Heard learned counsel for petitioner and perused the record.
2. Grievance of petitioner is that she has not been paid benefit of scheme launched by Government, namely, "Mukhyamantri Kisan Evam Sarvahit Beema Yojna" and in this regard she has made a representation dated 12.02.2019 to District Magistrate, copy whereof has been placed on record as Annexure-6 to writ petition, but no decision has been taken thereon so far. 3. Learned Standing Counsel fairly submitted that in case such a representation is pending and has not been decided so far, the same would be decided expeditiously.
4. In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the competent authority to consider petitioner's aforesaid representation and pass a reasoned and speaking order therein within a period of one month from the date of production of a certified copy of this order before him."
When the aforesaid order was not complied with, Contempt Application (Civil) No. 1276 of 2020 ( Raj Kumari Vs. Shri Yogesh Kumar, Divisional Manager Divisional Office) was filed by the applicant which was finally disposed of by this court on 04.03.2020 While dispose of the aforesaid contempt application following directions were given:-
"The applicant shall supply a duly stamped registered envelope addressed to the opposite parties and another self-addressed stamped envelope to the office within two weeks from today. The office shall send a copy of this order along with the self-addressed stamped envelope of the applicant with a copy of contempt application to the opposite parties within one week, thereafter and keep a record thereof. The opposite party shall comply with the directions of the writ Court and intimate the applicant of the order through the self-addressed envelop within a week, thereafter."
Today when the matter is taken up, it is informed by learned counsel for the applicant that due to mistake, the aforesaid part of direction was not complied with by the applicant and prays for some time to comply with the aforesaid part of the directions given by this Court.
In the facts and circumstances of the case, this contempt application is disposed of permitting the applicant to comply with aforesaid part of the order dated 04.03.2020 passed in contempt application within two weeks from today. In case, the aforesaid part of the order will be complied with within stipulated period, the opposite party is directed to comply with the order of the writ court in its letter and spirits as directed by this court in order dated 04.03.2020 passed in contempt application.
