Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.
The only grievance of the petitioner is that the Case No.77/2000-01 (New Case No.12/2007-08/77-2010-11) under Section 176 of UP ZA & LR Act (Smt. Raj Kumari vs. Ram Chand & others) is pending before the second respondent, Court of Assistant Collector, First Class, Banda but the same has not been decided so far.
Learned Standing Counsel fairly states that in case the aforesaid case is still pending and has not been disposed of, the same shall be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the second respondent to consider and decide the aforesaid case after providing opportunity of hearing to all the stake holders, within a period of six months from the date of production of a certified copy of this order before him.
