Heard learned counsel for the petitioner, Sushree Archana Singh learned counsel for the respondent bank, learned Standing Counsel and perused the record.
Learned counsel for the petitioner submitted that there was commercial loan in the year 1979 from the State Bank of India , Mirzapur. No mortgage was created in respect of the loan. There was doubt in payment. The suit was filed. Total due amount is Rs.80,00,000/. Earlier there was offer which was accepted by the bank for one time settlement but due to death of husband of the petitioner that could not be materialised. Now the petitioner is ready to one time settlement to deposit the amount of loan taken by her husband and partner of the Firm. The petitioner is aged about 72 years.
Learned counsel for the respondent bank submitted that if there is pressure from side of the petitioner for one time settlement, then the same will be considered.
Considered the submissions of counsel for the parties.
In view of the above, if fresh proposal is submitted by the petitioner before the respondent no.2 within a week, it is expected that the same shall be considered, as expeditiously as possible, preferably within a period of three weeks.
With the above observation this petition is finally disposed off.
