Petitioner is aggrieved by an order of transfer dated 22.05.2018 as well as consequential relieving vide order dated 29.07.2018. Petitioner has been transferred from Bareilly to Shahjahanpur. The order of transfer is challenged on the ground that the petitioner's wife is suffering from cancer and she is being attended to by the doctors at New Delhi. Prayer is made to direct the authorities to consider petitioner's claim for being posted at a place where better medical facilities could be made available to petitioner's wife.
Petition is opposed by the learned standing counsel.
It transpires that petitioner was continuing at Bareilly for the last nearly 10 years. In such circumstances, no error is found in the order of transfer. Petitioner has, otherwise, been relieved. No interference, therefore, is called for with the orders impugned.
In the facts and circumstances of the case, noticed above,it is, however, provided that in case petitioner joins pursuant to the relieving order and represents for being posted at a place where better medical facility is available to his wife within a period of two weeks from today, the authority concerned shall consider such representation, in accordance with law, within a period of two months thereafter.
Subject to observations aforesaid, this petition stands disposed of.
