Hon'ble Alok Mathur,J.
1. Heard learned counsel for the petitioner as well as learned Standing Counsel for the State respondents.
2. Learned counsel for petitioner submits that inadvertently Tehsildar has been mentioned instead of Nayab Tehsildar in th memo of petition as well as in the prayer of the petition and seeks permitted for correction of the same.
3. Accordingly, the prayer is allowed.
4. Learned counsel for petitioner is directed to correct the array of parties and well as relief clause forthwith.
5. In view of the order proposed to be passed, requirement of issuance of notice to respondent nos. 2 to 12 are hereby dispensed with.
6. Instant petition has been filed by the petitioner praying for direction to the respondent No. 1 - Nayab Tehsildar, Tehsil - Khalilabad, District Sant Kabir Nagar to decide the case originally numbered as Case No. 1136 of 2013 (Computerized Case No. T201317650200079), Ashok Kumar & others Vs. Ram Narayan,) under Section 34 of Land Revenue Act, within the time frame fixed by this Court.
7. Learned counsel for the petitioner submits that grievance of the petition would be sufficiently met in case respondent No. 1 - Nayab Tehsildar, Tehsil - Khalilabad, District Sant Kabir Nagar, considers and decides the aforesaid case in the time bound manner.
8. Learned Standing Counsel has no objection to the aforesaid prayer.
9. Considering the facts and circumstances of the case, without entering into the merits, respondent No. 1 - Nayab Tehsildar, Tehsil - Khalilabad, District Sant Kabir Nagar is directed to decide case originally numbered as Case No. 1136 of 2013 (Computerized Case No. T201317650200079), Ashok Kumar & others Vs. Ram Narayan,) under Section 34 of Land Revenue Act, expeditiously, say within a period of three months from the date of production of certified copy of this order, in accordance with law, if there is no legal impediment.
10. It is further directed that the parties to the case shall cooperate in expeditious disposal of the case and shall not seek any unnecessary adjournment, neither any such adjournment shall be granted by the Court concerned, except in exceptional circumstances.
11. With above observations/directions, the writ petition stands disposed of.
