This writ petition has been filed challenging impugned F.I.R. dated 20.04.2021 arising out of Case Crime No.122 of 2021, under Sections 147, 148, 149, 395, 397, 332, 353, 504, 506, 427, 336, 307, 34 I.P.C, 7 Criminal Law (Amendment) Act 1932 and Sections 131,132(3) &135(A) People Representation Act 1950, 1951, 1989, related to Police Station Kandhai, District Pratapgarh.
After arguing the matter at some length, learned counsel for the petitioner(s) states that he may be permitted to withdraw this writ petition with liberty to the petitioner(s) to take recourse to the remedy available under Section 438 Cr.P.C.
Accordingly, the writ petition is disposed of with aforesaid liberty.
However, it is directed that in case the petitioner(s) approach(es) the court of competent jurisdiction by way of moving appropriate application under Section 438 Cr.P.C., the same shall be considered and decided in accordance with law, with expedition.
