1. Heard learned counsel for petitioner and learned Standing Counsel as well as Sri Nand Lal, Advocate holding brief of Sri B.N. Singh, learned counsel for respondents.
2. Writ petition is directed against fresh notice dated 09.04.2018 whereby U.P. Higher Education Service Commission (hereinafter referred to as “Commission”) has notified that fresh advertisement shall be made for making recruitment on the post of Assistant Professor (Commerce).
3. Learned counsel for petitioner submitted that earlier in 2014 said post was advertised and selection was made but result had not been declared and now cancelling same Commission is going to make fresh advertisement.
4. Petitioner is only a candidate pursuant to earlier advertisement and we do not find any indefeasible right of petitioner to insist that Commission must declare result of earlier selection. It is always open to Commission to cancel earlier selection proceeding and proceed to make fresh selection. No plea of mala fide has been raised in writ petition and none has been impleaded eo nomine.
5. In these facts and circumstances, we find no merit in writ petition. Dismissed accordingly.
