Petitioners claim that they have been appointed on Class- IV posts in the institution concerned after following the due procedure prescribed in the year 1987. Appointment of the petitioners were approved by the District Basic Education Officer Farrukhabad on 2.7.1987. The institution itself has been brought in the list of aided institution. Grievance is that though petitioners have been consistently approaching the authorities but till date salary has not been released to them. Prayer has been made in this petition to direct the respondents to release salary of the petitioners alongwith arrears and interest accrued there on.
Sri S.K. Verma, learned counsel for the the respondent District Basic Education Officer concerned that the petitioner's claim shall be examined by the authority concerned, in accordance with law.
In the facts and circumstances, noticed above, writ petition stands disposed of, permitting the petitioners to approach respondent no. 2 in respect of their grievance, within a period of two weeks from the date of presentation of certified copy of this order, annexing all materials in support of their claim. The authority concerned shall consider the claim of the petitioners and take an appropriate decision within a period of three months thereafter. It is clarified that this Court has not adjudicated petitioners' entitlement to receive salary and all such issues are left open to be examined by the authorities concerned, at the first instance, in accordance with law.
