Heard learned counsel for the petitioner and Shri Madan Mohan Chaurasia, learned counsel appearing for respondents no. 2 to 4.
It is the case of the petitioner that he was working as regular Mali since 1986 with the respondents. He was falsely implicated on 11.03.2014 in an F.I.R. in Case Crime No. 132 of 2014, under Sections 420, 467, 468, 471, 120-B IPC and was also sent to jail on 17.01.2014. It was on the information provided by the police that the respondent no. 4 passed a suspension order on 15.09.2014 when it was found that the petitioner was in jail for more than 48 hours. The petitioner was granted bail by the Hon'ble High Court of Uttrakhand at Nainital on 15.10.2014 in Criminal Misc. Bail Application No. 998 of 2014.
After the petitioner was granted bail, the petitioner has made several representations on various dates, copies of which have been collectively filed as Annexure-3 to the writ petition. Till date the respondents have not allowed the petitioner to resume his services.
The writ petition is disposed of with a direction to respondent no. 4 (Executive Engineer, Construction Division, 26, Avas Vikas Parishad, Moradabad) to take an appropriate decision in the matter on the representations pending for almost four years. He should pass a reasoned and speaking order with regard to subsistence allowance and arrears of salary, if any, within a period of two months from the date a certified copy of this order is filed before him.
