This writ petition has been filed with the prayer to quash the notice dated 1.11.2018 issued by the Additional District Magistrate (F&R), Bijnor in Case No. D20181360002228 (State vs. Raj Kumar), under Section 3(1) U.P. Control of Goonda Act, Police Station Mandawar, District- Bijnor.
Heard learned counsel for the petitioner and learned A.G.A. for the State. Perused the record.
This Court does not see any illegality in the impugned notice or the proceedings. This writ petition is clearly premature. We do not see any finding in the impugned notice which may be read against the petitioner at this stage so far. The petitioner can always approach the concerned Magistrate to show cause and defend himself. There is no good ground to scuttle the proceedings at this premature stage.
The writ petitioner lacks merit and stands dismissed.
