This writ petition has been filed seeking following relief:-
"issue a writ, order or direction in the nature of mandamus directing the learned court below to decide the suit no. RST/01024/2018 (Computerize No. T201814180401024) of 2015 (Daya Ram versus Jhuri & others) under Section 229-B U.P.Z.A. & L.R. Act, 1950 as expeditiously as possible, pending in the court of Sub Divisional Magistrate Tehsil Mughal Sarai District Chandauli, within stipulatd period or as fixed by this Hon'ble court may deem fit and proper, during the pendency of the present petition before this Hon'ble Court."
It has been stated that suit under Section 229 B of the U.P.Z.A. & L.R. Act filed by the petitioners in the year 2015 has not decided till date.
From the perusal of the order sheet of the proceedings filed on record as also the submission made by counsel for the petitioners, it transpires that in the suit the issues have not yet been framed. It necessarily follows that the parties have not adduced their evidence.
Under the circumstances, this writ petition is disposed of with the observation that the trial court may endeavour to decide the suit within a period of one year from the date of production of a certified copy of this order before him.
