Heard learned counsel for the petitioner and learned Standing Counsel for respondents.
The petitioner has filed an application under Section 34 of the U.P. Revenue Code, 2006 for mutation of his name which has been registered as Case No. 02131 of 2020 (Computer Case No. T202005440402131) (Raj Kumar and other vs. Kotwal).
The petitioner wants that the aforesaid case be decided expeditiously.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.2 to decide the case of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of directing the respondent no.2, Tehsildar, Tehsil Kasya, District Kushinagar to decide the Case No. 02131 of 2020 (Computer Case No. T202005440402131) (Raj Kumar and other vs. Kotwal) expeditiously preferably within a period of one year from the date of production of a copy of this order, strictly in accordance with law.
The writ petition is disposed of subject to the observations made above.
In view of the fact that due to the pandemic of COVID-19, the certified copy is not being issued by the High Court, therefore, the order downloaded from the website duly certified by learned counsel for the petitioner may be treated as true copy of the order and the Authority may not refuse to comply the order on the ground of non filing of certified copy of the order.
