Heard learned counsel for the petitioner, learned Standing Counsel for the State respondent and Shri Aditya Bhushan Singhal, learned counsel for U.P. Jal Nigam Ltd.
Present writ petition has been preferred for a direction to respondent authorities to implement the recommendation of 6th Pay Commission on the petitioner with effect from 01.012006 in accordance to the Government Order No.vay.aa-2- 1314(1)/dus-59 (em)/2008 dated 08.12.2008 and to pay the arrears of differences of amount of salary and other post retiral benefits to the petitioner alongwith 12% interest.
In support of his submission, learned counsel for the petitioner has placed reliance on order dated 19.02.2021 passed in Writ A no.1776/2021 (Girja Shankar and others vs. State of U.P. and others), wherein, writ petition was allowed asking the respondents to release the arrears of 6th Pay Commission report w.e.f. 01.01.2006 till the petitioners remained in service, release the arrears of pension and also to re-determine their pension etc.
Learned Standing Counsel very fairly states that in case approaches the competent authority, the grievance of the petitioner would be looked into, examined and remedied at the earliest.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of finally with the direction that in case petitioner moves a fresh representation/application before the Competent Authority/third respondent within two weeks from today, this Court hopes and trust that the Authority concerned would proceed to consider and decide the claim of the petitioner within further period of two months, keeping in mind the observations made in Girja Shankar (supra).
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
