Heard counsel for the petitioner, learned Standing Counsel representing State, learned counsel appearing on behalf of the Gaon Sabha and perused the record.
The present writ petition has been filed beseeching the expeditious disposal of appeal No.
193 of 2021 (Raj Kumar vs. Harish Chandra and others) pending in the court of respondent No. 1, Commissioner Vindhyachal Division, Mirzapur.
It is submitted by learned counsel for the petitioner that the petitioner has filed an appeal against the order dated 1.3.2021 passed by the passed by the Sub Divisional Officer, Mirzapur in proceedings under Sections 144 of the U.P. Revenue Code, 2006. The aforesaid appeal is pending protracted since the date of its filing i.e. 25.2.2021 and no fruitful steps are being taken by the court concerned to decide it at the earliest.
Learned Standing Counsel and counsel for the Gaon Sabha have no objection in case a direction is issued for early disposal of the case.
In this conspectus, as above, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to (respondent No. 1), before whom the aforementioned matter is pending disposal, to decide the same expeditiously, preferably, within a period of one year from the date of receipt of a certified copy of this order.
It is expected that it should be decided by a reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments to either of the parties.
With the aforesaid direction, present writ petition is disposed of.
