Heard learned counsel for the applicant as well as learned AGA for the State and perused the material on record.
This bail application has been moved on behalf of applicant Raj Kumar @ Rajey in case crime no.220 of 2010, u/s 380 & 411 IPC, P.S. Partapur, district Meerut.
It is contended by learned counsel for the applicant that the applicant is only a driver of the alleged Tempo. No FIR regarding the theft of the alleged four rollers has been lodged by the caretaker of the Spinning Mill or any other authorised person so far. No public witness has been taken at the time of alleged recovery of the rollers. Offence is triable by Magistrate Ist class.
According to the prosecution case, four rollers are said to have been stolen in a Tempo having no registration number and it was apprehended by the Police Authorities on 7.4.2010 on the information of informer at 19.55 p.m. Learned AGA opposed the bail application.
Considered the submissions made by the learned counsels for the parties and considering the nature of offence and quantum of sentence provided for, without expressing any opinion on the merits of the case, the applicant is entitled to be enlarged on bail.
Let the applicant Raj Kumar @ Rajey involved in case crime no.220 of 2010, u/s 380 & 411 IPC, P.S. Partapur, district Meerut be released on bail on executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of court concerned.
