Heard learned counsel for the parties and perused the record.
Petitioners are currently working as an Assistant Teachers in Upper Primary Schools. Earlier they were appointed as Assistant Teachers in Primary Schools and getting the grade pay of Rs. 4200/- and later on they were promoted as Assistant Teachers in Upper Primary Schools and the pay grade was enhanced from Rs. 4200/- to 4600/- and thereafter it appears that the petitioners made some request for inter-district transfer and accordingly, the petitioners were transferred to different districts and they were given posting as Assistant Teachers in different Primary Schools.
Since the petitioners were given inter-district transfer and their grade pay was reduced from Rs. 4600/- to 4200/-, they have questioned the action taken by the respondents as to once a particular grade pay was given to them then how the same could be reduced from Rs. 4600/- to 4200/- and accordingly, they made a representation and reminder in this regard on 05.09.2018 and 28.09.2018 for proper fixation of pay considering the last pay drawn from the place from which they were transferred to different districts.
Sri Ashok Kumar Yadav, learned counsel for respondent nos. 2, 3 to 4 contends that respondent no. 3 is the competent authority who may look into the grievance of the petitioner as raised before this Court.
Since, the matter is required to be examined at the end of respondent no. 3, I hereby direct Basic Shiksha Adhikari, Allahabad the 3rd respondent to look into the matter with regard to the fixation of pay of the petitioners and other allied benefits. In the event, petitioners make a detailed representation before respondent no. 3 within a period of four weeks' from today along with a certified copy of this order, the same shall be considered and decided strictly in accordance with law by respondent no. 3 within a further period of six weeks.
With the aforesaid observations/directions, the instant writ petition is finally disposed of.
