Heard learned counsel for the applicant and learned A.G.A for the State.
This application under Section 482 Cr.P.C. has been filed with a prayer to allow the present criminal misc. application directing the C.J.M. Gorakhpur to expeditiously decide the Criminal Case No. 6155 of 2016 (earlier 602/16) Raj Kumar Vs. Anil Kumar Tripathi (arises out of case crime no. 39 of 2016, Police Station Cantt, District Gorakhpur, under Sections 419, 420, 467, 468, 471, 120B IPC.
Learned counsel for the applicant submits that one hand the criminal case has remained pending since 2016, on the other hand the order sheet of the case would reveal that the case has remained pending at the stage of framing of charges on last one year.
Considering the fact that the trial has remained pending for very long and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, without granting any unnecessary or long adjournments as expeditiously as possible, preferably within a period of two months from the date of production of a certified copy of this order, if there is no other legal impediment.
