Heard Sri Rahul Agarwal, learned counsel for the petitioner, Sri Shivam Shukla, Advocate holding brief of Sri Rohan Gupta, learned counsel appearing for respondent nos. 2 and 3, learned Standing Counsel for the State and perused the record.
By means of this writ petition under article 226 of the constitution, the petitioner has prayed for early disposal of his pending application dated 10th October, 2018 which he has filed for setting aside the ex-parte order passed by the Deputy Chairman on 22nd of September, 2017. It is stated that the matter is unnecessarily being lingered on whereas all the parties have already been put to notice.
Learned counsel for the respondents states that he has no objection in case direction is issued for early disposal of the pending application of the petitioner in a time bond period.
In view of the above and without entering into the merit of the application on record, we hereby direct the Deputy Chairman, Kanpur Development Authority, namely, respondent no. 2 to decide the pending application of petitioner dated 10th of October, 2018 as expeditiously as possible preferably within a period of three months from the date of production of a certified copy of the order. Needless to add that the order shall be reasoned and speaking one after giving full opportunity of hearing to all the concerned parties.
With the aforesaid observations and directions, the writ petition stands disposed of.
