Sri Gyan Prakash, learned counsel for the respondents has produced instructions before this Court.
As per the instructions, petitioner no. 1 applied for Constable (G.D.) in CAPFs & Rifleman (GD) in Assam Rifles, 2013 and the petitioner no. 2 Sri Ajay Kumar applied for Constable (GD) in CAPFs & Rifleman (GD) in Assam Rifles, 2012. They have obtained very low marks and therefore their names failed to find place in the list of recommended candidates.
The instructions dated 19.9.2018 shows that petitioner no. 1 had obtained 59 marks for selection in Assam Rifles, 2013 and the last selected candidate for OBC category had obtained following marks in different category which is as follows:-
In BSF, the last cut off 81 marks. In CISF, the last cut of 83 marks. In CRPF, the last cut of 80 marks. In ITBP, the last cut off 77 marks and in Assam Rifles, the last cut off 76 marks.
The petitioner no. 2 - Ajay Kumar secured 59 marks wherein the selection for Assam Rifles, 2012 whereas the last cut off in OBC category was 76 marks for BSF, 80 marks for CISF, 74 marks for CRPF, 79 marks for SSB, 73 marks for ITBP and 73 marks for Assam Rifles.
It is apparent that the petitioner did not secure marks that would make them eligible for being appointed as per final result of the selection declared for 2012 on 17.10.2012. Both the petitioners are domicile of Firozabad district which is recognised as general area of State Code No. 33 (UP). The process of three recruitments held in the year 2010, 2013 and 2015 already stands completed. The writ petition has been filed with a delay of more than four years.
The writ petition therefore being devoid of merits is dismissed.
The instructions dated 19.9.2018 are kept on record.
