Heard learned counsel for the petitioner and Sri Parashuram Cahubey, learned counsel appearing for the Bank of Baroda.
The petitioner is challenging recovery certificate dated 7.8.2019 for a sum of Rs. 4,27,053/- plus others. The aforesaid recovery is in respect of a loan amount taken by the petitioner for business purpose.
Learned counsel for the petitioner accepts the liability to pay the said amount and submits that he is ready and willing to pay the same provided some reasonable time is allowed and installments are fixed.
Learned counsel for the Bank of Baroda also wants that the amount be cleared at the earliest.
In view of the aforesaid facts and circumstances, we dispose of the writ petition in the ends of justice, with the direction to the petitioner to pay a sum of Rs. 1,27,053/- within a period of one month or latest by 31st October 2019 and the balance amount of Rs. 3 lakhs in three equal installments of Rs. 1 lakh each payable in the months of December, 2019, January and February, 2020 respectively.
The last installment will include all interest that may accrue on the aforesaid outstanding amount.
In the event of default in payment of any of the installments, the benefit of this order would automatically come to an end.
