Heard learned counsel for the petitioner, learned Standing Counsel appearing for the respondents No.1 and 2 and Sri Vimlesh Kumar Rai, learned counsel for the respondents No.3 and 4.
Learned counsel for the petitioner submitted that the contract was awarded to the petitioner for installation of 12 India Mark- II hand-pump/rebore/platform in October, 2011. As per contract the FDR was deposited for the work and the work was completed. Since the work has already been completed, the report was submitted for return of the FDR and the work satisfactory report was also given by the official concerned, though the FDR has been released and returned to the petitioner. However, the payment has not been made as yet in spite of repeated requests and therefore, a direction be issued to the respondent-Jal Nigam to release the payment to the petitioner for installation of 12 India Mark-II hand- pump/rebore/platform as per agreement.
Learned counsel for the respondent-Jal Nigam submits that if the work was satisfactory, he was entitled for payment, however, the work was not satisfactory.
Without going into the veracity of the assertions made in the writ petition, the respondents 1, 3 and 4 are directed to decide the representation and claim of the petitioner by passing a speaking and reasoned order preferably, within a period of two months from the date of production of a certified copy of this order.
With the aforesaid observation, the present writ petition is finally disposed of.
