Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.
Petitioner has approached this court interalia with following relief:-
"(a) issue a writ, order or direction in the nature of mandamus commanding the respondent no.1 and 6 to reckon the petitioner's work charge establishment services into regular services for the purpose of gratuity, pension and consequential benefits.
(b) Issue a writ, order or direction in the nature of mandamus commanding the respondent no.6 to grant the pension and consequential benefits to the petitioner."
Learned counsel for the petitioner submits that the controversy involved in the petition is squarely covered by a decision of Hon'ble the Apex Court in Prem Singh v. State of Uttar Pradesh and ors., Civil Appeal No. 6798 of 2019 dated 02.09.2019. Therefore, it is urged that the writ petition may be decided in terms of the aforementioned decision.
Learned counsel for the respondents does not dispute the legal proposition.
No useful purpose would be served in keeping the writ petition pending consideration.
Accordingly, writ petition is disposed of asking the Competent Authority to look into the grievance of the petitioner and pass appropriate order strictly in consonance with the judgement passed by Hon'ble the Apex Court in Prem Singh (supra), expeditiously preferably within a period of two months from the date of production of certified copy of this order.
