This application seeks quashing of complaint dated 10 November 1998, summoning order dated 26 May 2000 passed by the Chief Judicial Magistrate and order dated 9 April 2002 passed by the Judicial Magistrate, Kayamganj as well as the entire criminal proceedings of Criminal Case No. 74 of 2001, under Sections 380, 457, 504, 506 I.P.C. pending in the Court of Judicial Magistrate, Kayamganj, District Farrukhabad.
From a bare perusal of the allegations made in the complaint which stand duly corroborated by the statements recorded by the Magistrate concerned, it cannot possibly at this stage and at least prima facie be said that the commission of offence as alleged is not evidenced.
The application is consequently dismissed. All interim orders shall stand discharged.
