Heard learned counsel for the petitioner and Sri J.S. Bundela learned Standing Counsel.
On the last occasion, the petitioner was granted time to file a supplementary affidavit. The issue itself arose since the petitioner was claiming notional promotion with effect from 05 May 1973. It appears that the petitioner alongwith other employees had petitioned the Public Service Tribunal Lucknow which had rendered judgment in their favour on 16 November 1998. The challenge to this decision of the Tribunal at the behest of the State was negatived by the judgment of the Division Bench of this Court with observations on 19 July 2007. The petitioner retired from service on 31 January 2008. During the period of service with the respondents, the claim for notional promotion was not raised. He however appears to have moved an application sometime in 2013 for being granted this relief. There is no explanation in the entire writ petition for the evident and inordinate laches from which the claim, as raised today, suffers.
Consequently the Court finds no ground to entertain this petition which shall stand dismissed.
