Heard Sri Puneet Srivastava, learned counsel for the applicant and Sri Abhinav Prasad, learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed for a suitable direction to the learned Additional Chief Judicial Magistrate-I, Aligarh to decide the Case No.435/2010 (State Vs. Raj Bahadur) arising out of Case Crime No.230 of 2009, under Section 3/7 of E.C. Act, Police Station Lodha, District Aligarh, pending in the Court of learned Additional Chief Judicial Magistrate-I, Aligarh, within stipulated period.
No useful purpose would be served in keeping the petition pending, which is finally disposed of with a direction to learned Additional Chief Judicial Magistrate-I, Aligarh to consider and decide the Case No.435/2010 (State Vs. Raj Bahadur) arising out of Case Crime No.230 of 2009, under Section 3/7 of E.C. Act, Police Station Lodha, District Aligarh, pending in the Court of learned Additional Chief Judicial Magistrate-I, Aligarh, most expeditiously, preferably within a period of six months from the date of production of certified copy of this order, before concerned court below, in accordance with law, after hearing the concerned parties, without granting unnecessary adjournment to either of the party, in case the proceedings of the aforesaid case, is not stayed by any Court.
