Heard Sri Sunil Kumar Yadav, learned counsel for the petitioners and Sri Anand Kumar Srivastava, learned counsel for the respondents.
The present petition seeks to challenge the order dated 22.11.2018 passed by the Civil Judge (Junior Division), Haveli, Azamgarh in Original Suit No.389 of 2018 (Suneeta Vs. Raj Bahadur & Anr.) whereby the application for temporary injunction filed by the plaintiff-respondent had been allowed. The petitioners have also sought to challenge the order dated 19.11.2019 passed by the Additional District Judge, Court No.3, Azamgarh in Misc. Appeal No.03 of 2019 which had been filed thereagainst.
The order dated 19.11.2019 passed in Misc. Appeal No.03 of 2019 indicates that the order dated 22.11.2018 passed by the trial court in terms of which temporary injunction had been granted in respect of land bearing arazi no.1036 has been modified and the order of temporary injunction is now in respect of the land bearing arazi no.1036-M. The appeal has thereafter been dismissed.
In view of the aforesaid modification made in terms of the order dated 19.11.2019 passed in the aforesaid Misc. Appeal, counsel for the petitioners states that he does not wish to press the present petition.
The petition is accordingly dismissed as not pressed.
