JUDGMENT / ORDER

Heard Sri Umesh Pratap Singh, learned Counsel for the petitioners and Ms. Nand Prabha Shukla, learned AGA for the State/respondents no. 1 to 3.
This writ petition has been filed by the petitioners, Raj Bahadur Verma, Smt. Vimla, Smt. Urmila Devi, Makdoom Verma, Smt. Shiv Kumari, Samarjeet Verma and Master Lavkush Verma through next friend Smt. Urmila Devi, seeking to quash the First Information Report No. 0446 of 2020, under Sections 147, 323, 504, 506, 452, 354-A I.P.C., Police Station Sangrampur, District Amethi.
It has been pointed out at the very outset by the learned AGA that in the present case, the investigation has already been concluded and charge-sheet has been forwarded to the Circle Officer on 09.01.2021. She is unable to inform as to whether the said charge-sheet has reached to the Court or not and as to whether the Court concerned has taken cognizance on the same.
Learned Counsel for the petitioners submits that petitioners are the members of common family. He submits that complainant along with his family members were trying to raise forceful construction over Gata No. 501, which is recorded in the name of Kali Mata Mandir. In this regard, the petitioners had made written complaint to the Superintendent of Police, Amethi and Principal Secretary, State of U.P. vide registered post dated 17.11.2020. He submits that impugned F.I.R. lodged by the private respondent is only a counter blast to the said incident just to harass the petitioners.
In view of the aforesaid, we direct the Investigating Officer to submit the police report in accordance with law before the competent Court within three weeks from today, if the same has not been submitted till date.
Till submission of police report before the Court concerned, no coercive action against the petitioners in pursuance of the impugned F.I.R. shall be taken.
The writ petition stands disposed of, accordingly.
