1. Learned counsel for the petitioner is permitted to implead the Assistant General Manager, Bank of Baroda, Regional Office Varanasi as respondent no.3 during the course of the day.
2. Inasmuch no firm cause of action appears to have crystallized to the petitioner and only a demand note appears to have been issued without being followed by a recovery certificate, it appears proper that the grievance raised by the petitioner in this petition may be raised before respondent no.3 by means of a proper written representation, which may be filed within a period of three weeks from today alongwith a certified copy of this order.
3. Shri Vishnu Pratap, learned counsel appearing for respondent nos. 2 and 3 assures that, in the event of such a representation being filed, proper consideration would be offered by respondent no.3 and an order would be passed within a period of one month therefrom before proceeding to make any coercive measure.
4. Accordingly, this petition is disposed of with a direction to the petitioner to file a representation within a period of three weeks alongwith a certified copy of this order before respondent no.3 which may be decided within a period of one month therefrom before taking any coercive measure against the petitioner.
