1. The present application is filed by the convict through his mother seeking temporary bail for a period of 60 days so as to undertake agricultural operation.
2. RULE.
Mr.H.K.Patel, learned Additional Public Prosecutor waives service of Rule on behalf of the respondent-State.
3. Learned APP made available the jail remarks. The convict is undergoing life imprisonment for offences under Sections 302, 323, 324, 147 and 149 of the Indian Penal Code in Sessions Case No.1 of 2008, wherein he was convicted by judgment and order dated 29.01.2010. As on 28.06.2012, the convict has undergone 4 years, 7 months and 4 days. He has enjoyed temporary bail on two different occasions. He has also enjoyed one furlough. Every time he has reported in time. Last he was out in the month of May 2011 on the occasion of marriages of his nephew and niece. Nothing adverse is reported against him in the jail remarks.
4. For the contents of the application, the same is allowed. The convict is ordered to be released on temporary bail for a period of 30 days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities.
5. The convict shall surrender to the Jail authorities on expiry of the temporary bail period.
6. Rule is made absolute.
