Heard learned counsel for the petitioner and Shri Rajesh Kumar, learned Standing Counsel for State respondents. Shri Arun Kumar Srivastava appears for Gaon Sabha.
The petitioner is before this Court for a direction to third respondent i.e. Asstt. Collector/Up-Zila Adhikari, Tehsil Nagina, Distt. Bijnor to preserve and protect the plantation made by the petitioner on plots bearing no.1284 area 0.506 hectares from the encroachment.
It is contended that under the government scheme the land in question has been given to the petitioner for plantation. It is alleged that adjacent plot holders always break the boundary (med) of the plot.
Regarding her grievance the petitioner has also made detailed representation on 22.01.2018 before the District Magistrate, Bijnor on which the District Magistrate has invited comments from the SDM concerned but no action has been taken on it and as such it is requested that the said representation is liable to be decided expeditiously.
Considering the facts and circumstances of the case and with the consent, the writ petition stands disposed of asking the District Magistrate, Bijnor to decide the aforesaid application/representation in accordance with law expeditiously and preferably within six weeks from the date of production of certified copy of this order.
