From the pleadings which have been mentioned in the writ petition, petitioner has been arrayed as an accused in Case Crime No. 11 of 2009, under Sections, 147, 148, 149, 448, 454, 307, 504,506 I.P.C., P.S. Shahganj, District Allahabad. In the said criminal case, this court on 6.7.2009 has stayed the arrest of the petitioner till credible evidence is not collected by the Investigating Officer. Fact of the matter is that investigation is on going. Petitioner's counsel is not in a position to say anything as to whether investigation has been concluded or not and as such it would be appropriate that present matter be listed after four months. This order has been passed in presence of both the counsel.
