Judgment: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) We have heard the learned counsel for the parties and gone through the impugned order.
It appears that the impugned order has been passed as an interim measure. The learned trial Judge considered the prima facie case and thought it fit that the interim order should not continue. According to us, he rightly vacated the interim order.
Under the circumstances, we request the learned trial Judge to decide the writ petition as early as possible. If the appellant-writ petitioner succeeds in the writ petition, then appropriate relief may be granted by the learned trial Judge. It will be open for the appellant-writ petitioner to approach the learned trial Judge for early hearing of the writ petition.
The writ appeal is accordingly disposed of.
Consequently, the miscellaneous petitions, if any pending, shall also stand dismissed. No costs.
