Heard learned counsel for the applicant, learned AGA for the State and perused the record.
Learned counsel for the applicant submitted that two witnesses of fact have already been examined and the applicant is languishing in jail since 25.01.2017, therefore considering that the applicant is languishing in jail for more than one and a half month, he be enlarged on bail in case crime no. 24 of 2017, under sections 498-A, 304-B IPC and 3/4 of the Dowry Prohibition Act, P.S. Balaini, District Baghpat.
Perusal of the record reveals that the deceased suffered 100% burn injuries.
Keeping in view the severity of the offence, evidence, complicity of the accused, without expressing any opinion on merits, this Court declines to grant any relief to the accused applicant.
The application for bail is, accordingly, rejected.
However, the trial court is expected to gear up the trial of the aforesaid case and conclude the same within six months from the receipt of this order, in accordance with law, without granting any unnecessary adjournment to either of the parties, provided the applicant fully cooperates in conclusion of the trial.
Office is directed to transmit a certified copy of this order to the court concerned within a fortnight.
