Heard learned counsel for the petitioners and learned A.G.A. for the State and perused the record.
Challenge in the writ petition is to the impugned F.I.R. dated 28.11.2020 giving rise to Case Crime No. 106 of 2020, under Sections 498-A, 323, 376, 377, 307 I.P.C. and Section 3/4 of the Dowry Prohibition Act, 1961, Police Station- Mahila Thana, District- Aligarh.
The instant writ petition is on behalf of Rahul, the Dewar of the victim and first informant. There is a clear allegation of rape against the petitioner in the first information report, whose correctness cannot be examined in this petition.
For this reason alone, despite the submissions made by learned counsel for the petitioner, which can at best be stated to be his defence, this Court does not find it a fit case for interference.
The writ petition is accordingly, dismissed.
