Petitioner is the first accused in Crime No.969 of 2014 of the Kayamkulam Police Station for the offences punishable under Sections 143, 147, 148, 323, 324, 452, 308 r/w Section 149 of the Indian Penal Code, Section 20 r/w Section 27 of the Arms Act, apprehends arrest and has filed this application.
2. Learned Public Prosecutor has opposed the application. It is submitted that on 06.04.2014 at about 07.15.p.m, the petitioner and other accused trespassed into the house of the de facto complainant and attacked him with sword, iron rod etc. Petitioner used the iron rod. It is also submitted that the 3rd accused moved this Court for pre-arrest bail which was rejected.
3. Learned counsel submits that one of the accused, Amal is a Cancer patient. According to the learned counsel, it is a case of group clash.
4. In the nature of the allegations made against the B.A.No.4104 of 2014 2 petitioner and the investigation required to be done, request for pre-arrest bail cannot be allowed.
Application is dismissed.
