Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with a prayer to direct the learned Additional Chief Judicial Magistrate-Ist, Pilibhit to decide the Case No. 1531 of 2017 (Rahul Verma Vs. Buddhsen), under Section 138 of Negotiable Instruments Act, Police Station Barkhera, District Pilibhit within stipulated period.
Learned counsel for the applicant has submitted that the complaint has been filed by the applicant on 17.02.2017 and since then, proceeding has been lingering-on, on one pretext or the other.
In view of the provision of Section 143(3) of the Negotiable Instruments Act, learned court below is directed to make all endeavours to decide the aforesaid case as expeditiously as possible, preferably within a period of four months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid case.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
