Heard learned counsel for the petitioner and the learned Standing Counsel for the State respondents.
Petitioner who is an Assistant Teacher in an educational institution is aggrieved by the action of the respondents in requiring him to discharge duties of a Booth Level Officer. Although before this Court it is not disputed that as of today no elections are being held, the Court only notes that the assignment of duties to a teacher in an educational institution would clearly fall foul of the decision rendered by the Division Bench of the Court in Sunita Sharma Advocate High Court & Another Vs. State of U.P. & 3 Others, [Public Interest Litigation (PIL) No. 11028 of 2015, decided on 8 August 2016]. The legal position in this respect is not disputed on behalf of the State respondents. The concession in this regard is taken note of.
Petition stands disposed of.
