This petition has been filed for a direction upon the respondents to consider petitioner's claim for appointment to the post of Constable (GD) in any of the unit of the Sashastra Seema Bal, as per judgment of the Delhi High Court as also the judgment of Rajasthan High Court. According to petitioner, he has scored 35 marks, which is the cut-off in his category.
Sri Gyan Prakash, learned Assistant Solicitor General of India has raised an objection with regard to maintainability of the writ petition on the ground that result of recruitment was declared in November, 2011 and a period of nearly 7 years have lapsed since then. It is stated that except to file the present writ petition there is nothing on record to indicate that petitioner has ever raised any claim. It is stated that recruitment proceedings have been concluded and subsequent recruitment thereafter have also been held. It is also stated that pursuant to orders passed by the Delhi High Court applications were entertained till 31.3.2015, but petitioner does not appear to have raised any grievance and his claim is grossly barred by latches.
Except to state that petitioner was not aware of such development, there is no explanation as to why this petition has been filed after 7 years. Admittedly, recruitment was finalized in the year 2011. Even after the orders passed by Delhi High Court, applicants have not availed opportunity to represent in the matter till 31.3.2015. Even thereafter the petitioner does not appear to have raised any claim. The Court cannot cannot help those who do not remain vigilant to their claims and awake after a long slumber.
Writ petition is, accordingly, dismissed.
