Heard learned counsel for the petitioner and Sri A.P. Paul, brief holder, appearing for the State.
The writ petition has been filed seeking direction on the respondents to remove encroachment and constructions raised on the public way.
Learned Standing Counsel submits that the process to remove encroachment has already been initiated under the provisions of Section 122-B of the U.P.Z.A and L.R. Act. The matter could not be concluded due to the reason given in the written instructions.
We find that process has already been initiated to remove the encroachment on the public way, but it shall not drag for long.
Accordingly, we dispose of this petition with a direction to the respondents to complete the proceeding under Section 122-B of the Act within a period of four months from the date of receipt of a copy of this order.
The compliance report therefrom shall be sent to this Court by the officer concerned and, accordingly, information about this order be conveyed to the officer concerned even by the learned Standing Counsel appearing for the State for prompt compliance.
With the aforesaid observations, the petition stands disposed of.
