This anticipatory bail application u/s 438 Cr.P.C. has been moved seeking the bail of applicant namely Rahul Gautam in the event of his arrest in Case Crime No.379 of 2019, under Sections 376, 504 and 506 I.P.C. and Section 5/6 of POCSO Act, P.S. Machhalishahar, District Jaunpur.
Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
It appears to be a case of deceitful sexual exploitation of the victim who is said to be mentally weak. The victim also conceived and is carrying pregnancy. According to the parents of the victim, when request to accept the victim as wife and have marriage with her was made, the accused instead of making relationship legitimate insisted for getting the conception aborted. There is no good reason to see the false implication of the applicant in the case. No good ground for grant of anticipatory bail in favour of the applicant is made out .
Accordingly, the anticipatory bail application is rejected.
It is clarified that the observations, if any, made in this order are strictly confined to the disposal of the bail application and must not be construed to have any reflection on the ultimate merits of the case.
