Heard counsel for the parties and perused the record.
Petitioner claims that he is entitled to appointment under the Dying-in-Harness Rules, 1974 being the legal heir of late Sri Brijendra Singh, who died while in service. It is argued that the petitioner had applied on compassionate ground and in fact, the letter dated 10.12.2020, on record, shows that the Senior Superintendent of Police, Bulandshahar had written a note seeking approval for appointment to the Recruitment Board, however, no action has been taken thereafter.
Standing Counsel, on instructions, states that SSP, Bulandshahar has referred the matter to the Selection Board, Lucknow and the matter is pending consideration there. Standing Counsel further argues that in fact the petitioner had applied for consideration of some other post subsequently he amended his application and papers with regard to character verification and eligibility criteria of the petitioner was referred to the Board, which is pending consideration there.
In view of the said statement, the present writ petition is disposed off with a direction to the Respondent No. 2 to take a decision in pursuance of the application dated 10.12.2020 sent by the Respondent No. 3 (Annexure No. 7) as expeditiously as possible preferably within a period of two months from the date of filing of a copy of this order before the Respondent No. 3.
The writ petition stands disposed off in terms of the said order.
