Heard learned counsel for the petitioner and learned A.G.A. for the State.
Rahul @ Yogesh has moved this Court by way of filing e- petition under Article 226 of the Constitution of India submitting that no case is being made out against him in the impugned F.I.R. dated 24.6.2020 registered as Case Crime No. 426 of 2020 under Sections 8/20 of the Narcotic Drugs and Psychotropic Act, 1985, Police Station Dadri, District Gautam Budh Nagar. He tried to surrender before the Court but at that time the police authorities conveyed that no case is made out against him. But, thereafter, the petitioner was declared absconder by the police, which appears from item no.7 in the chart under the head List of Dates and Events.
After considering the facts and submissions, it is directed that if the petitioner still wants to surrender before the Court, the court shall look into the factual data and pass reasoned order in this matter.
This petition is disposed of .
