Respondent Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioner herein on Bail in the event of her arrest in Crime No. 552/2013 on the file of the Central Crime Station, Hyderabad.
The petition coming on for hearing, upon perusing the petition and the Memo of grounds filed herein, and upon hearing the arguments of SRI P. DURGA PRASAD, Advocate for the Petitioner and of the Additional Public Prosecutor, for the Respondent, the Court made the following.
ORDER The petitioner is A2. He seeks for grant of anticipatory bail. He allegedly committed matrimonial offences. The learned Additional Public Prosecutor submitted that no part of the cause of action has arisen in Andhra Pradesh for entertaining the bail application. However, the complaint was entertained by the learned XIII Additional Chief Metropolitan Magistrate, Hyderabad. Therefore, the case arises within the territorial limits of this Court.
Where the offences alleged are matrimonial offences and where the petitioner is a lady, I consider it appropriate to enlarge the petitioner on anticipatory bail.
Hence, this Petition is allowed. The petitioner shall surrender before the XIII Additional Chief Metropolitan Magistrate, Hyderabad, within two weeks from today. On such surrender, the learned XIII Additional Chief Metropolitan Magistrate, Hyderabad, shall enlarge the petitioner on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.
