Present petition has been filed for setting aside the order dated 9.8.2018 passed by Prescribed Authority, Moradabad in P.A. Misc. No. 22 of 2015 (Ram Chandra Sharma vs. Rahman Miyan) arising out of P.A. Case No. 43 of 1998.
Sri Pankaj Agarwal, learned counsel for the respondent has produced a copy of the memo of possession dated 5.9.2018, which clearly indicates that the possession has already been handed over to the landlord and copy of the same is taken on record.
In such view of the matter, present petition has become infructuous and the same is, accordingly, dismissed as having become infructuous.
Since the petitioner's counsel is not present, in case, the facts as stated are incorrect, the petitioner is at liberty to file application for recall of this order.
Learned counsel for the petitioner may inform learned counsel for the respondent about this order in writing.
