Having heard learned advocate for the petitioners and considering the nature of allegations levelled against the petitioners that they have created false record about birth of 8th child of the complainant, who was elected Deputy Sarpanch of Gram Panchayat and, for which he came to be suspended, I am of the considered opinion that the above aspect is required to be investigated by the Investigating Officer.
In view of the above, I am not inclined to exercise powers under Section 482 of the Code of Criminal Procedure, 1973 in favour of the petitioners.
Accordingly, this petition fails and is hereby dismissed.
Notice is discharged.
