JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
The present application has been preferred by applicant-convict through his mother for temporary bail on the ground that he wants to take care of his father's treatment.
Medical papers are produced and so the ground appears to be genuine.
It appears from the jail report that the convict was earlier released on temporary bail and he has surrendered but late by 6 days for which the punishment has been imposed upon him but the fact remains that he has surrendered with the jail authority.
Under the circumstances, the applicant-convict be released on temporary bail for a period of 3 (three) weeks from the date of his actual release on condition that he furnishes the personal bond of Rs.5000/- (Rupees Five Thousand Only) with one surety of the like amount with the further direction that he shall mark his presence with the concerned police station of the area of his residence and upon the expiry of the period, he shall surrender with the jail authority.
Application is allowed to the aforesaid extent. Rule made absolute.
Learned APP shall communicate this order to the concerned jail authority.
