The petition filed is wholly defective, inasmuch as, neither the font size nor the spacing nor the margin are as prescribed. Further, the annexure no.2 to the writ petition is not legible. It's typed copy has not been annexed with the other Judge copy.
Sri Byas Kumar Prasad and Sri Azhar Hussain, learned counsel for the petitioner have stated that this is the first mistake that has occurred in any petition filed by them. They undertake not to allow such mistake to reoccur in future. The stamp reporter was also called to explain why the defects noted above have not been noticed and reported by him. He regrets his mistake.
In view of the above undertaking given by learned counsel for the petitioner, they are permitted to withdraw the writ petition. The writ petition is accordingly dismissed as withdrawn with liberty to file a fresh/proper petition.
Stamp reporter is also directed to be more careful in future. Such occurrence not only results in wastage of time but also causes inconvenience to the Court.
