JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 03.03.2017 CORAM THE HONOURABLE MR. JUSTICE V.BHARATHIDASAN Crl.O.P.No.4229 of 2017 Criminal Original Petition filed under Section 482 Cr.P.C. to issue necessary direction to the respondent not to harass the petitioner and her family members.
For Petitioner : M/s.P.V.Sudakar For respondent : Mr.C.Emalias, Addl. Public Prosecutor ORDER This petition has been filed to direct the respondent police not to harass the petitioner and her family members on the complaint preferred by the defacto complainant, without due process of law.
2. Heard the learned counsel for the petitioner and the Additional Public Prosecutor appearing for the State.
3. On a complaint given by one Ibrahim, petition enquiry is pending. Under such circumstances, blanket order of 'not to harass' cannot be passed. The petitioner shall co-operate for the enquiry and during the course of enquiry, she shall not be harassed. However, if any cognizable offence is made out, this order would not be a shield against the arrest of the accused.
4. With the above observation, this Criminal Original Petition is disposed of.
